Customer own data
As a provider of services, we may receive, process or store certain information, including personal data, on behalf of our customers. All such information ("Customer Data") is owned and controlled by our Customers: In accordance with EU data protection law, they are the data controllers of this information. Customer Data may include information from endpoints and other systems, tools or devices that Customers manage or monitor through our Services, as well as end-user data related to individual activities on Customer's network and systems. It may also include event logs, end user information (such as IP address, email address, and computer name), and other data if relevant to a support or service request. Dynamicsproject.com is a data processor with respect to customer data. This means that Dynamicsproject.com processes Customer Data based on instructions from its customers. When Dynamicsproject.com receives a request from a data subject, Dynamicsproject.com may refer it to its customer, as the customer is the data controller of the customer data.
Data about our customers and users of our websites
Dynamicsproject.com collects information in the normal course of its business and in managing its relationships with customers. This information may include personal data.
Business Contact and Customer Relationship Management. We collect and maintain information about our customers, which may include company names, business contact names and titles, telephone numbers, email address, and other contact information. We may also collect billing addresses, bank accounts, credit card information, order details, subscription and license information, and usage details. In addition, we collect login and profile data (name, contact, authorized users) from users and account administrators authorized by the customer.
Data submitted to websites. In order to access or use certain parts of the Sites, to use the full functionality of the Sites, or to transact or seek to transact business with us, you may be asked to provide us with certain personal information, including in the following ways:
- By filling out forms (such as a contact form) on our websites, at trade shows, or at other places where we do business;
- by downloading or accessing Dynamicsproject.com services;
- by downloading materials from our websites;
- by signing up for newsletters or other communications; or
- By communicating with us by phone, email or otherwise using our contact information.
Typically, personal information you provide to us includes name, business affiliation, business address, telephone number, and email address, as well as any personal information needed to resolve inquiries or complaints.

Customer Support and Service. When customers contact us for support or other customer service requests, we retain support tickets and other records relating to the requests, including information provided by customers in connection with such support or service requests. In addition, we may retain telephone records related to support and customer service.
Use Data. We collect information about our customers' use of our Services, including IP address, customer ID, email address, and other usage statistics. We do not collect Usage Data from Customer end users unless necessary to support or provide the Services requested by Customers (in which case we are a data processor of that data).
When you visit our websites, our server automatically collects certain browser- or device-generated information, which in some cases may constitute personal data, including, but not limited to:
- your domain;
- Your IP address;
- Your date, time and duration of your visit;
- Your browser;
- Your operating system;
- Pages you visit;
- Third party information;
- Other information about your computer or device; or
- Internet traffic.
Anonymized Data. Subject to the terms of applicable customer agreements, we may anonymize or aggregate certain data we collect in such a way that it can no longer be associated with a particular customer or data subject ("anonymized data"). We may use this data to improve our Services, analyze trends, publish market research, and for other marketing, research or statistical purposes. In addition, we may share this data with third parties for these specific purposes.
Personal data use
Below is an overview of our uses for personal data that we process as a data controller. Further details on how we process your personal data may be provided to you in a separate notice or as part of a contract.
For individuals in the European Union, our processing (i.e. use) of your personal data is justified based on the following legal bases:
- Contract performance: Processing is necessary to perform a contract with you or to take steps leading to the conclusion of a contract in response to your request;
- Compliance with Laws: Processing is necessary for us to comply with a relevant legal obligation (e.g., laws that require us to obtain tax information from customers, to conduct customer checks, or to disclose information to government or regulatory authorities);
- Defense of our rights: Where processing is necessary for the establishment, exercise or defense of legal claims; or
- With your consent: you have consented to the processing (e.g., if we are required by local law to rely on your prior consent for direct marketing purposes)

Personal data disclosure
Dynamicsproject.com is a global group of companies, and we may share personal information with our affiliates in the course of our business and administration of the Services. We may also engage third party vendors (acting on our instructions) to assist us in providing information, products or services to you, in conducting and managing our business, or in administering and improving our Services or the Sites. Dynamicsproject.com may disclose your personal information to these affiliates and third parties to perform services that these third parties engaged by Dynamicsproject.com perform on Dynamicsproject.com's behalf, subject to appropriate contractual restrictions and safeguards, or if we believe it is reasonably necessary to prevent harm or loss, or if we believe that such disclosure may assist in an investigation of suspected or actual illegal activity.
Dynamicsproject.com reserves the right to disclose information that is not Personal Data or is otherwise not subject to contractual restrictions.
When personal data is transferred outside the EU to third party providers, we will take steps to ensure that your personal data receives the same level of protection as if it remained within the EU. To this end, we ensure, among other things: the conclusion of data transfer agreements, the use of standard contractual clauses approved by the European Commission or certification schemes such as the EU-US Privacy Shield.
We contractually require our agents, service providers, and affiliates who may process personal data in connection with the Services to provide the level of protection for personal data required by the Principles. Currently, Dynamicsproject.com does not disclose Personal Data to third parties for their own use, but only for Dynamicsproject.com's purposes as explained above. Under the Principles, Dynamicsproject.com remains liable if one of its third-party processors processes personal data in a manner that does not comply with the Principles if we are responsible for the event causing the damage.
Law Enforcement or National Security True. In accordance with our legal obligations, we may also disclose customer information to government agencies for law enforcement or national security purposes upon lawful request.
Other Disclosurestrue. We may also disclose customer information (including personally identifiable information) when otherwise required by law.
Corporate Transfers. We may also disclose personal information to third parties in connection with a potential or actual sale of our business or any of our assets or assets of an affiliated company. In this case, personal information we have stored about our users may be one of the transferred assets.
Just-in-Time Disclosures. Additional disclosures or information about the processing of personal data in connection with certain websites, mobile applications, products, services or programs may be provided to you. These may supplement and/or clarify Dynamicsproject.com's privacy practices in certain circumstances and provide you with additional choices regarding how Dynamicsproject.com may process your personal data.
The Sites, Services and Portal are not intended for use by children under the age of 16. The personal data of children under the age of 16 is not knowingly collected, stored, disclosed or used by Dynamicsproject.com. If you are under 16, please do not provide any personally identifiable information, even if the Sites ask you to do so. If you are under 16 and have provided personally identifiable information, please ask your parent(s) or legal guardian(s) to notify Dynamicsproject.com. To the extent lawful and, where necessary, subject to your consent, we may communicate with customers (and their related business contacts) about our Services. If you no longer wish to receive marketing communications, please visit the Email Settings Center on our website or use the Email Settings link in our promotional emails to unsubscribe from marketing communications.
Dynamicsproject.com strives to secure and protect your personal information from unauthorized access, misuse or disclosure, unauthorized alteration or unlawful destruction, and accidental loss. To that end, Dynamicsproject.com employs certain reasonable procedures, systems and technologies. However, you acknowledge that no environment is completely secure or error-free, and that these procedures, systems and technologies employed by Dynamicsproject.com may be compromised. Accordingly, we cannot be held responsible for unauthorized or accidental access that is beyond our control.
Retention of your personal information
We apply a general rule of retaining personal information only as long as necessary to fulfill the purposes for which it was collected. However, in certain circumstances, we may retain personal data for a different period of time, such as when we are required to do so pursuant to legal, tax and accounting requirements, or for as long as is necessary if we are required to do so pursuant to legal process, by a judicial authority or other governmental body that has the authority to make such a request.

Information and data subject rights
Individuals have the right of access regarding personal data processed about them, subject to applicable law; individuals may request access to their personal data processed by us by sending us a message at DSGVO (GDPR) - personal data request.
Subject to applicable law, you may also have some or all of the following rights with respect to your personal information:
- The right to receive a copy of your personal data indicating how and on what basis such personal data is processed;
- The right to have inaccurate personal data corrected (including the right to have incomplete personal data completed);
- The right to erasure of personal data (in a limited number of cases, e.g., when such data are no longer necessary for the purposes for which they were collected or processed);
- The right to restrict the processing of your personal data in certain circumstances;
- The right to have your data transferred in machine-readable form to a third party (or to yourself) if we justify our processing based on your consent or the performance of a contract with you;
- The right to withdraw your consent to the processing of your personal data (where such processing is based on your consent); and
- The right to obtain or inspect a copy of the appropriate safeguards pursuant to which your personal information is transferred to a third country or international organization.
In addition to the rights listed above, data subjects have the right under the EU Data Protection Act to object at any time, on grounds relating to their particular situation, to the processing of their personal data in which we have legitimate interests. This also applies to profiling based on these provisions (contrary to your consent) or for the performance of a contract with you. You also have the right to object at any time to the processing of your personal data for direct marketing purposes, including profiling for marketing purposes.
You also have the right to file a complaint with your local supervisory authority with regard to data protection.

Please note that we may request proof of identity and we reserve the right to charge a fee if permitted by law, particularly if your request is manifestly unfounded or disproportionate. We will endeavor to respond to your request within all applicable time limits.
If you contact us regarding customer data with respect to which we are a data processor, we will attempt to direct your inquiry to the appropriate customer and data controller for your personal data.
Settlement of Privacy Shield disputes
We invite individuals from the EU and Switzerland to contact us at email@example.com with questions or complaints about how we process their personal information under the Privacy Shield. We will endeavor to resolve your concern as soon as possible, and in any event within 45 days of receipt.
If you are a citizen of the EU or Switzerland and cannot resolve a complaint through one of the above avenues, you may be able to seek binding arbitration through a Privacy Shield Committee in accordance with the Privacy Shield Framework at www.privacyshield.gov/article?id=How-to-Submit-a-Complaint.
