Through the DynamicsProject Online Store, Olav Treffurt IT Consulting provides you with access resources, including, but not limited to, the Website, information about software, services and other merchandise that may be available for purchase, download areas, software and TERMINATION OF SITE USE.
Tools (collectively, the "Services"). The Services, including any updates, enhancements, new features and/or the addition of new web properties, are subject to these Terms of Use and Sale ("Terms of Use and Sale" or "Agreement"). By using the Site, purchasing products from the DynamicsProject Online Store, or using any Services, you acknowledge and agree to be bound by these Terms of Use and Sale, Olav Treffurt IT Consulting's Privacy Policy (see the "PRIVACY AND PROTECTION OF PERSONAL INFORMATION" section below), and any applicable terms, policies, or exclusions referenced herein and accessible through the applicable hyperlinks (collectively, the "DynamicsProject Online Store Policies"). • END USERS ONLY

  You must be an end user to purchase products from the DynamicsProject online store. Trading partners are not eligible to purchase products from the website.

Sie erklären sich damit einverstanden, alle internationalen und nationalen Gesetze und Regelungen einzuhalten, die für Sie in Bezug auf diese Produkte gelten.

• PRODUCT AVAILABILITY AND QUANTITY AND ORDER RESTRICTIONS

  Prices and availability of products are subject to change at any time without notice, but you will always be charged the price displayed at the time of order confirmation. Olav Treffurt IT Consulting may set a limit on the quantities that can be purchased per order, per account, per credit card, per person or per company, which you will be notified of on the Site or before we accept the order.

  Olav Treffurt IT Consulting shall have the right to refuse or reject any order at any time for any reason, including, without limitation, if you have not complied with the terms and conditions set forth at the time of the order, if your payment cannot be processed, if the products or services ordered are unavailable, or for manifest error on the Site or in connection with your order, in which case any monies paid to you for the order will be refunded. If we are unable to provide the products or services you ordered, we will contact you and may offer you an alternative product instead. If you choose not to purchase the alternative product, we will cancel your order. In the event of manifest errors on the Site or in connection with your order, we reserve the right to correct the error and charge you the correct price. In this case, we will contact you and offer you the option to purchase the product at the correct price or cancel your order.

  Unless a specific delivery period is stated at the time you place the order, your products or services will be delivered within thirty (30) days from the date of your order. Credits or refunds will be issued via the same payment method and to the same account that you used to place the order.




• SOFTWARE ACQUISITION AND LICENSING TERMS

  Software made available for download from the DynamicsProject online shop ("Software") and other merchandise (including Services) available on the DynamicsProject online shop or Services are the copyrighted work of Olav Treffurt IT Consulting and/or its suppliers. When you purchase software, you are actually purchasing a licence to use the software and not the software itself. Software licenses purchased from the DynamicsProject online shop are governed by the license agreement that accompanies the software product (the "License Agreement"). You are required to agree to the terms of the Licence Agreement upon installation of the Software.

  Any reproduction or redistribution of the Software not in accordance with the relevant licence agreement and applicable law is expressly prohibited and may result in severe civil and criminal penalties. Violators may be subject to severe prosecution.

  Please respect the intellectual property rights and copyright of others when using the tools and utilities provided in the DynamicsProject Online Store or Services or in software products.




• ELECTRONIC SOFTWARE DOWNLOADS

  Electronic Software Download ("ESD") products are delivered to you by providing a download link in your DynamicsProject.com account associated with your product purchase. Subject to the paragraph above, we will store the download link and associated digital key in your DynamicsProject.com account for three (3) years from the date of purchase. ESD subscription products may have different terms and storage rights. At the time of your subscription, you will be asked to review and agree to them.

  You agree that we may cancel or modify our digital key storage program at any time. You also agree that we may terminate support for the storage of keys for one or more products for legitimate reasons, such as at the end of the product support lifecycle, after which you will no longer be able to access the download link or digital key. If we cancel or change our program so that you can no longer access the download link or digital keys in your account, we will provide you with at least 90 days' notice to the contact information for the associated DynamicsProject.com account.




• OTHER REGULATIONS

  In addition to software and ESD products, you may also be offered other products and services available for purchase or trial on DynamicsProject.com that are subject to separate end user license agreements, terms of use, or other terms. If you purchase or use these products, you may also be required to accept these terms as a condition of purchase, installation, or use.




• PRODUCTS WITH AUTOMATIC RENEWAL

  To the extent automatic renewals are permitted in your country, region, state or canton, you may purchase Subscription Products from us that automatically renew. If you purchase such Subscription Products, (i) you represent and warrant that you are authorized to use the payment method you provide and that all payment information you provide is true and correct, (ii) you authorize Olav Treffurt IT Consulting to charge you for the Services using your payment method, and (iii) you authorize Olav Treffurt IT Consulting to charge you for any paid features of the Services that you have signed up for or are using while this Agreement is in effect. We will notify you by email prior to any automatic renewal of a subscription product. Once we have notified you that your subscription will automatically renew, we may automatically renew your Services and charge you the then-current price for the renewal period. In addition, we will provide you with a reminder that we will charge you for renewing the Services through your selected payment method, whether it was available to us on the date of renewal or communicated to us later. We will also provide you with instructions on how to cancel the Services. You must cancel the Services prior to the renewal date to avoid being billed for the renewal.




• PRICE AND PAYMENT

  The price of products in the DynamicsProject online store is as stated on the website.

  DynamicsProject online store pricing is based on the sale of software to individual end users, commercial organization, educational institution or government organization.

  We may offer you the opportunity to pre-order a product from our website before it is available for purchase. If you choose to pre-order a product, we may place a hold on your credit card for the applicable amount at the time of the pre-order. However, we will not charge your credit card until the date the product is made available to you for download or the date we ship your product. If the advertised price of the product decreases between the date you place your pre-order and the date the product is available for download or shipment, we will charge you the lower price. You have the right to cancel your pre-order at any time before the Product is available for download by contacting Customer Support at the number listed on our Sales and support -page. Once your pre-order is available for download, our normal return policy will apply. If a specific product has a different pre-order policy, we will indicate that on the website.

  Prices shown on the Website include all taxes and fees ("Taxes") that may apply to your purchase. Prices displayed on the Site do not include delivery charges. Delivery charges will be added to the amount of your purchase and displayed on the checkout page. You will have an opportunity to review any delivery charges that apply to your purchase before confirming your purchase. Each item in your cart is displayed with the current item price.

  Product offerings in the DynamicsProject online store do not constitute a binding offer by us. By clicking "Complete Purchase", "Submit Order" or a similar button to send your order to us, you are submitting a binding offer to us with respect to all products in your shopping cart. If we accept your order, you will receive an e-mail with an automatic purchase confirmation. The purchase contract is concluded by this e-mail.

  The DynamicsProject online store offers several payment options, which are indicated on our website. We reserve the right to change our payment options at any time and for any reason.




• RETURN POLICY

  The DynamicsProject online store return policy is set forth below. The return policy is provided in addition to any statutory return rights you may have under the law.

  You may withdraw from this Agreement without cause within fourteen (14) calendar days. The withdrawal period will expire fourteen (14) days after any of the following events:

  (i) For ESD Products and Services, when the Product is made available for download or the Service begins. You agree that we have the right to begin the Service or ESD Product immediately upon purchase; and
  

  (ii) For physical products, as of delivery.

  If applicable law in your country or region gives you a longer withdrawal period, that period will apply.

  To exercise your right of withdrawal, you must inform us of your decision before the end of the withdrawal period. Contact us through the Sales and Support to notify us of your decision and initiate the return process.

  As a condition of return and to the extent permitted by law, the following requirements apply. All products must be returned with reasonable care (for example, they must not show signs of wear or damage and must be in a condition that allows us to resell them). All software in a retail package and video games must be returned with the seal intact. Services must not have been delivered or used by you. If ESD products are returned, we may also require you to sign an electronic confirmation of destruction as a condition of withdrawal from this Agreement.

  We are entitled to extend the period for the right of withdrawal during the Christmas period or at other times. If a longer period is indicated on our website, the period indicated there shall apply.

  All returns must be accompanied by the original sales receipt or gift receipt, original documentation, manuals with instructions, registration. Subject to applicable law, refunds or exchanges may be prevented or delayed, or additional charges may apply if these items are not included, and Olav Treffurt IT Consulting reserves the right to refuse returns or exchanges if they do not meet our return criteria.

  Exceptions

  • Upgrade Option and Returns. If you purchased an item with an upgrade option, returns are subject to the fourteen (14) day return period and the following special return procedures apply:
  • If you return the Item prior to the release of the Upgrade Product, you will not receive the Upgrade Product.
  • If you return the item after the upgrade product is released, you must return the item and the upgrade product together.

  If we offer promotions that save you money when you purchase a combination of products, all products purchased as part of the promotion must be returned in order to receive a refund. If your promotion included a service that you have already used, the full retail value of the service will be deducted from the amount of your refund.

  Offers for a Trial Period. If you participate in an offer for a trial period and we do not notify you otherwise, you are required to cancel the Service at the end of the trial period to avoid incurring new charges. If you do not cancel the Service at the end of the Trial Period, we may charge you for the Service.

• AMENDMENT OF THE PROVISIONS

  The Terms of Use and Sale in effect at the time you agreed to them govern your purchase and act as the contract of sale between us. Prior to your next purchase, Olav Treffurt IT Consulting may have updated the terms of use and sale without notice to you. Remember to review the Terms of Use and Sale each time you visit the DynamicsProject online shop. We recommend that you obtain a copy of the Terms of use and sale store or print for reference purposes and for use in connection with your purchase.

  EXCEPT AS EXPRESSLY WARRANTED IN THE LICENSE AGREEMENT OR IN ANY MANUFACTURER'S WARRANTY THAT MAY ACCOMPANY THE PRODUCT, NO WARRANTY IS MADE.

  OLAV TREFFURT IT CONSULTING MAKES NO SPECIFIC REPRESENTATIONS OR WARRANTIES AND MAKES NO REPRESENTATIONS OF CONDITIONS WITH RESPECT TO THE PRODUCTS, INCLUDING AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. OLAV TREFFURT IT CONSULTING PROVIDES YOU WITH THE PROTECTION AND BENEFIT OF ANY APPLICABLE LAW OR STATUTORY WARRANTY APPLICABLE TO DEFECTIVE PRODUCTS.

  THE DYNAMICSPROJECT ONLINE STORE AND ITS CONTENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE". NEITHER OLAV TREFFURT IT CONSULTING NOR ITS SUPPLIERS MAKE ANY REPRESENTATIONS OR WARRANTIES OTHER THAN THOSE EXPRESSLY CONTAINED HEREIN WITH RESPECT TO THE DYNAMICSPROJECT ONLINE STORE, INCLUDING WITHOUT LIMITATION, THAT YOUR USE OF THE DYNAMICSPROJECT ONLINE STORE WILL BE UNINTERRUPTED OR ERROR-FREE. WE EXCLUDE NEITHER OUR LIABILITY NOR THE LIABILITY OF OUR AGENTS FOR FRAUD OR INJURY TO BODY OR HEALTH OR DEATH CAUSED BY NEGLIGENCE.




• GENERAL PROVISIONS

  Interpretation of the contract
  If in any jurisdiction any provision of this Agreement or the application thereof to any party or circumstance is limited, prohibited or unenforceable, such provision shall be effective in relation to that jurisdiction without invalidating the remaining provisions of this Agreement and without affecting the validity or enforceability of such provisions in any other jurisdiction or affecting their application to any other party or circumstance. Where possible, such provisions should be applied to the fullest extent permitted by law and interpreted and applied to the lesser extent necessary for them to be valid.

  Assignment
  Olav Treffurt IT Consulting may assign, transfer or otherwise dispose of all or any of its rights and obligations under this Agreement at any time without notice to you. You may not assign this Agreement or transfer any rights for use under this Agreement.

  Claims
  Claims must be made within the time period prescribed by applicable law. If your claim is not made in time, it is permanently barred.

  No third-party beneficiaries
  This Agreement is for the exclusive benefit of you and Olav Treffurt IT Consulting. It is not for the benefit of any other person, except permitted successors and assigns.

  Communications and communication
  For customer support requests, please refer to the Sales and support page of the website. In the event of a dispute, please contact Olav Treffurt IT Consulting at the address given above in these terms of use and sale.

  Applicable law
  The laws of Germany govern all claims, including claims in respect of breach of contract, breach of warranty, under consumer protection laws, under unfair competition laws and under tort law. With respect to the law of the jurisdiction, you are entitled to direct the competent court in Germany for all disputes arising out of or in connection with this Agreement.

  Notifications of claims of copyright infringement should be sent to Olav Treffurt IT Consulting's designated agent. REQUESTS THAT ARE SUBMITTED BUT DO NOT RELATE TO THE PROCEEDING WILL BE
