• SOFTWARE ACQUISITION AND LICENSING TERMS

  Software made available for download from the DynamicsProject online shop ("Software") and other merchandise (including Services) available on the DynamicsProject online shop or Services are the copyrighted work of Olav Treffurt IT Consulting and/or its suppliers. When you purchase software, you are actually purchasing a licence to use the software and not the software itself. Software licenses purchased from the DynamicsProject online shop are governed by the license agreement that accompanies the software product (the "License Agreement"). You are required to agree to the terms of the Licence Agreement upon installation of the Software.

  Any reproduction or redistribution of the Software not in accordance with the relevant licence agreement and applicable law is expressly prohibited and may result in severe civil and criminal penalties. Violators may be subject to severe prosecution.

  Please respect the intellectual property rights and copyright of others when using the tools and utilities provided in the DynamicsProject Online Store or Services or in software products.




• ELECTRONIC SOFTWARE DOWNLOADS

  Elektronische Softwaredownload ESD‑Produkte werden durch Bereitstellen eines Downloadlinks in Ihrem DynamicsProject.com-Account, das mit Ihrem Produktkauf verknüpft ist, an Sie geliefert.   You agree that we may cancel or modify our digital key storage program at any time. You also agree that we may terminate support for the storage of keys for one or more products for legitimate reasons, such as at the end of the product support lifecycle, after which you will no longer be able to access the download link or digital key. If we cancel or change our program so that you can no longer access the download link or digital keys in your account, we will provide you with at least 90 days' notice to the contact information for the associated DynamicsProject.com account.




• OTHER REGULATIONS

  In addition to software and ESD products, you may also be offered other products and services available for purchase or trial on DynamicsProject.com that are subject to separate end user license agreements, terms of use, or other terms. If you purchase or use these products, you may also be required to accept these terms as a condition of purchase, installation, or use.




• PRODUCTS WITH AUTOMATIC RENEWAL

  Sofern automatische Verlängerungen in Ihrem Land, Ihrer Region, Ihrem Bundesland oder Kanton zulässig sind, können Sie Abonnements von uns erwerben, die sich automatisch verlängern. Wenn Sie solche Abonnementprodukte erwerben, (i) sichern Sie zu, dass Sie autorisiert sind, die von Ihnen bereitgestellte Zahlungsmethode zu verwenden, und alle von Ihnen bereitgestellten Zahlungsinformationen wahr und richtig sind, (ii) autorisieren Sie Olav Treffurt IT Consulting, Ihnen die Gebühren für die Dienste unter Verwendung Ihrer Zahlungsmethode in Rechnung zu stellen, und (iii) autorisieren Sie Olav Treffurt IT Consulting, Ihnen die Gebühren für alle kostenpflichtigen Features der Dienste in Rechnung zu stellen, für die Sie sich angemeldet haben oder die Sie verwenden, während dieser Vertrag Gültigkeit hat. Wir informieren Sie per E-Mail vor einer automatischen Verlängerung eines Abonnementproduktes. Sobald wir Sie darüber informiert haben, dass Ihr Abonnement automatisch verlängert wird, sind wir berechtigt, Ihre Dienste automatisch zu verlängern und Ihnen den dann geltenden aktuellen Preis für den Verlängerungszeitraum in Rechnung zu stellen. Ansonsten erhalten Sie von uns eine Erinnerung, dass wir Ihnen die Verlängerung der Dienste über Ihre gewählte Zahlungsmethode in Rechnung stellen, unabhängig davon, ob sie uns am Datum der Verlängerung vorlag oder später mitgeteilt wurde. Wir stellen Ihnen außerdem Anweisungen dazu bereit, wie Sie die Dienste kündigen können. Sie müssen die Dienste vor dem Verlängerungsdatum kündigen, um zu vermeiden, dass Ihnen die Verlängerung in Rechnung gestellt wird.




• PRICE AND PAYMENT

  The price of products in the DynamicsProject online store is as stated on the website.

  Prices shown on the Website include all taxes and fees ("Taxes") that may apply to your purchase. Prices displayed on the Site do not include delivery charges. Delivery charges will be added to the amount of your purchase and displayed on the checkout page. You will have an opportunity to review any delivery charges that apply to your purchase before confirming your purchase. Each item in your cart is displayed with the current item price.

  Product offerings in the DynamicsProject online store do not constitute a binding offer by us. By clicking "Complete Purchase", "Submit Order" or a similar button to send your order to us, you are submitting a binding offer to us with respect to all products in your shopping cart. If we accept your order, you will receive an e-mail with an automatic purchase confirmation. The purchase contract is concluded by this e-mail.

• RETURN POLICY

  You may withdraw from this Agreement without cause within fourteen (14) calendar days. The withdrawal period will expire fourteen (14) days after any of the following events:

  (i) For ESD Products and Services, when the Product is made available for download or the Service begins. You agree that we have the right to begin the Service or ESD Product immediately upon purchase; and
  

  (ii) For physical products, as of delivery.

  If applicable law in your country or region gives you a longer withdrawal period, that period will apply.

  To exercise your right of withdrawal, you must inform us of your decision before the end of the withdrawal period. Contact us through the Sales and Support to notify us of your decision and initiate the return process.

  As a condition of return and to the extent permitted by law, the following requirements apply. All products must be returned with reasonable care (for example, they must not show signs of wear or damage and must be in a condition that allows us to resell them). All software in a retail package and video games must be returned with the seal intact. Services must not have been delivered or used by you. If ESD products are returned, we may also require you to sign an electronic confirmation of destruction as a condition of withdrawal from this Agreement.

  We are entitled to extend the period for the right of withdrawal during the Christmas period or at other times. If a longer period is indicated on our website, the period indicated there shall apply.

  All returns must be accompanied by the original sales receipt or gift receipt, original documentation, manuals with instructions, registration. Subject to applicable law, refunds or exchanges may be prevented or delayed, or additional charges may apply if these items are not included, and Olav Treffurt IT Consulting reserves the right to refuse returns or exchanges if they do not meet our return criteria.

  Exceptions

  • Upgrade Option and Returns. If you purchased an item with an upgrade option, returns are subject to the fourteen (14) day return period and the following special return procedures apply:
  • If you return the Item prior to the release of the Upgrade Product, you will not receive the Upgrade Product.
  • If you return the item after the upgrade product is released, you must return the item and the upgrade product together.

  If we offer promotions that save you money when you purchase a combination of products, all products purchased as part of the promotion must be returned in order to receive a refund. If your promotion included a service that you have already used, the full retail value of the service will be deducted from the amount of your refund.

  Offers for a Trial Period. If you participate in an offer for a trial period and we do not notify you otherwise, you are required to cancel the Service at the end of the trial period to avoid incurring new charges. If you do not cancel the Service at the end of the Trial Period, we may charge you for the Service.

  EXCEPT AS EXPRESSLY WARRANTED IN THE LICENSE AGREEMENT OR IN ANY MANUFACTURER'S WARRANTY THAT MAY ACCOMPANY THE PRODUCT, NO WARRANTY IS MADE.

  OLAV TREFFURT IT CONSULTING MAKES NO SPECIFIC REPRESENTATIONS OR WARRANTIES AND MAKES NO REPRESENTATIONS OF CONDITIONS WITH RESPECT TO THE PRODUCTS, INCLUDING AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. OLAV TREFFURT IT CONSULTING PROVIDES YOU WITH THE PROTECTION AND BENEFIT OF ANY APPLICABLE LAW OR STATUTORY WARRANTY APPLICABLE TO DEFECTIVE PRODUCTS.

  THE DYNAMICSPROJECT ONLINE STORE AND ITS CONTENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE". NEITHER OLAV TREFFURT IT CONSULTING NOR ITS SUPPLIERS MAKE ANY REPRESENTATIONS OR WARRANTIES OTHER THAN THOSE EXPRESSLY CONTAINED HEREIN WITH RESPECT TO THE DYNAMICSPROJECT ONLINE STORE, INCLUDING WITHOUT LIMITATION, THAT YOUR USE OF THE DYNAMICSPROJECT ONLINE STORE WILL BE UNINTERRUPTED OR ERROR-FREE. • GENERAL PROVISIONS

  Interpretation of the contract
  If in any jurisdiction any provision of this Agreement or the application thereof to any party or circumstance is limited, prohibited or unenforceable, such provision shall be effective in relation to that jurisdiction without invalidating the remaining provisions of this Agreement and without affecting the validity or enforceability of such provisions in any other jurisdiction or affecting their application to any other party or circumstance. Where possible, such provisions should be applied to the fullest extent permitted by law and interpreted and applied to the lesser extent necessary for them to be valid.

  Assignment
  Olav Treffurt IT Consulting may assign, transfer or otherwise dispose of all or any of its rights and obligations under this Agreement at any time without notice to you. You may not assign this Agreement or transfer any rights for use under this Agreement.

  Claims
  Claims must be made within the time period prescribed by applicable law. If your claim is not made in time, it is permanently barred.

  No third-party beneficiaries
  Dieser Vertrag ist ausschließlich zu Ihren und Olav Treffurt IT Consulting Gunsten. Er ist nicht zugunsten einer anderen Person, mit Ausnahme zugelassener Nachfolger und Abtretungsempfänger.

  Communications and communication
